The Residential Tenancies Amendment Bill is due to have its second reading this week. We need this to be stopped otherwise your rights as a property owner will be diminished.

These are our concerns:
Removing the no cause 90-day notice no cause termination – this is an essential tool of last resort that landlords have to remove a disruptive or antisocial tenant from a property. It is rarely used but means the tenant can leave quietly without risk to the neighbours and without jeopardising their rental history or your property. The changes in the Bill helps to protect a small minority of tenants with disruptive and antisocial behaviour.
Fixed Term Tenancy – a fixed term tenancy should be exactly that – fixed for a certain period of time that both parties agree to at the start of the tenancy, no further paperwork should have to accompany this to end the tenancy.
New Criminal Penalties/Improvement notices/Pecuniary penalties/Enforceable undertakings – from the existing 24 unlawful acts against landlords in the RTA, this bill adds an extra 60 unlawful acts, 24 criminal charges and pecuniary penalties (up to $100,000). Additional Improvement Notices and Enforcement undertaking have also been added. This is completely unwarranted, a poor use of taxpayer money and will severely impact people’s willingness to provide rental property.
